Ethical and Legal Issues in Making Decisions for Older Persons Who Lack Decision-Making Capacity

Back by popular demand, WVNEC is offering a webinar on common questions asked about interpreting and applying advance directives and POST form orders. They were called into the Center for End-of-Life Care/West Virginia Network of Ethics Committees 800 number, 877-209-8086. They pertain to 1) making decisions with the Medical Power of Attorney (MPOA) representatives when there is conflict between them in what they think should be done; 2) what to do when the MPOA representative/surrogate is not authorized to change the POST form, but the patient’s condition has significantly deteriorated; and 3) to what extent can a POST form be modified after its completion when all parties present at the time of completion are not readily available.
Also, this webinar will respond to questions from participants regarding challenges they have faced in knowing how to implement advance directives and/or POST orders for a patient who has lost decision-making capacity.
Panelists
The panelists for the webinar are Stacie Honaker, Esq, the Risk Manager and Privacy Officer for the WVU Health Sciences Center and ex-officio member of the WVNEC Advisory Committee, and Alvin H. Moss, MD, a Professor of Medicine, and Executive Director of WVNEC. They will discuss these issues and more during the webinar. Learning Objectives
At the conclusion of the session, participants should be able to:
- Describe a process to address ethical and legal issues that arise in the interpretation and implementation of advance directives and medical orders in patients who have lost decision-making capacity;
- Cite West Virginia healthcare law relevant to cases involving ethical conflict; and
- Apply an ethics process and relevant healthcare law to resolve cases involving conflict.
