The number of persons for whom Adult Protective Services (APS) of the West Virginia Department of Human Services has responsibility as a legal guardian or health care surrogate has increased over the years and now numbers in the thousands. APS is frequently involved as the decision-maker for persons in hospitals and nursing homes. This webinar will focus on 1) what is the APS process for evaluating patients for abuse and neglect, 2) what is their procedure for deciding whether to agree to assume responsibility as a health care surrogate, and 3) what should be done in this case before removal of the surrogate appointment from the patient’s daughter?

The panelists for the webinar are Suzanne E. Messenger, JD, West Virginia State Long-term Care Ombudsman, Amber Moore, MSW/LSW, Program Manager, West Virginia Department of Human Services, Dan Miller, PhD, Assistant Professor in the Department of Philosophy, West Virginia University, and Alvin H. Moss, MD, a Professor of Medicine, West Virginia University School of Medicine, and Executive Director of WVNEC.
They will discuss the role of APS and the ethical and legal issues in the care of Mr. K. Please attend, chat in your questions and comments, and learn answers to your questions and those of others.
Learning Objectives
At the conclusion of the session, participants should be able to:
- Discuss the APS process for evaluating whether they should intervene in a case in which there is concern for abuse and neglect and agree to serve as health care surrogate for a patient who lacks decision-making capacity;
- Cite West Virginia healthcare law relevant to cases involving ethical conflict; and
- Apply an ethics process and relevant healthcare law to resolve cases involving conflict.
